Terms of Use

Glimmer & Stitch is a browser-based pattern maker for cross-stitch and diamond painting, developed and operated by Borduurshop Hengelo ("we", "us", or "our").

By accessing or using the Glimmer & Stitch pattern maker (the "Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Service.

If you use the Service on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms.

Glimmer & Stitch lets you convert photos into cross-stitch or diamond painting patterns, edit patterns in a browser-based editor, and export them as PDF files or in our native format (.gsp). Some features are available without an account; others require registration or the purchase of credits.

We may add, change, or remove features as the Service evolves. We'll communicate meaningful changes before they take effect.

You may use basic editing features without creating an account. To save patterns to the cloud, purchase credits, or access advanced features, you must register with a valid email address.

You are responsible for keeping your login details secure and for all activity that takes place under your account. Notify us immediately if you suspect unauthorised use. We reserve the right to suspend accounts that are being used abusively.

Credits are required to unlock and download full-resolution PDF exports. Credits do not expire once purchased and are non-refundable once consumed. All prices are displayed inclusive of applicable VAT. Payments are processed securely through Mollie.

Prices listed in the Service are correct at the time of publication. We reserve the right to adjust pricing, but any price that applies to your order at the moment of purchase will be honoured.

Because credits provide instant digital access to our export features, consumed credits cannot be refunded. Unconsumed credits may be refunded within 14 days of purchase if you have not used any of them.

EU consumers have a statutory 14-day right of withdrawal from the date of purchase for digital services, provided the digital content or service has not yet been accessed or used. By using a credit to generate a PDF export, you acknowledge that delivery has begun and this right lapses for those credits.

If something went wrong with your order or you feel you were charged in error, please contact us at info@borduurshophengelo.nl. We will always try to find a fair solution.

Everything you create in Glimmer & Stitch is yours. We do not claim any ownership over the patterns you design or the images you upload.

By uploading an image, you grant us a limited, non-exclusive, royalty-free licence to process and store it solely for the purpose of delivering the Service to you. We will never use your images for marketing, training data, or any other purpose.

You must ensure you have the right to use any images you upload. Do not upload images that infringe someone else's copyright or contain unlawful content. We reserve the right to remove such content without notice.

The Service — including its software, algorithms, design, thread colour databases, and documentation — is the intellectual property of Borduurshop Hengelo or used under licence. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.

DMC, Anchor, and other thread brand names are trademarks of their respective owners. We reference their colour ranges for compatibility purposes only. Glimmer & Stitch is not affiliated with or endorsed by any thread manufacturer.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Interfere with or disrupt the Service or servers connected to it
• Use bots, scrapers, or automated tools to extract data, patterns, or thread information from the Service
• Resell or sublicence access to the Service without our written permission
• Upload malicious files or attempt to circumvent usage limits through technical means

We aim to keep the Service running smoothly, but we cannot guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

Your saved patterns are stored securely and backed up regularly. We recommend keeping local copies of any patterns important to you. In the event of unexpected data loss, we will do everything reasonable to restore your work, but we cannot be held liable for loss of data.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or suitable for your specific purpose.

To the maximum extent permitted by Dutch law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service — including loss of patterns, loss of data, or loss of profits.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes liability for fraud, wilful misconduct, or anything that cannot be excluded under applicable law.

We may suspend or terminate your access to the Service at any time if you breach these Terms. You may close your account at any time by contacting us at info@borduurshophengelo.nl. Termination does not entitle you to a refund of unused credits, except where required by law.

These Terms are governed by Dutch law. Any disputes arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the competent court in Overijssel, the Netherlands.

If you are an EU consumer, nothing in these Terms affects your statutory rights under EU consumer protection law. For unresolved disputes, you may also contact WebwinkelKeur for mediation at webwinkelkeur.nl.

We may update these Terms from time to time as the Service evolves. The "Last updated" date at the top of this page reflects the most recent revision. We will notify you of significant changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
